# Arkansas Contractor Taxes and Licensing: Taxable Labor, Materials and Licenses

Arkansas taxes some contractor labor that most neighbors don't. Installing or repairing appliances, flooring, motors, machinery and electrical or mechanical components in an existing building is a taxable service, even when the item is attached to the building. The same installation in new construction isn't taxable. Contractors pay the 6.5% state tax plus local tax on materials.

## Key takeaways

- Initial installation in an existing building is taxable: collect tax on the install labor and the parts. In new construction, installers act as contractors and don't charge tax.
- Lawn care, landscaping, pest control and cleaning services are taxable in Arkansas.
- All contractors are consumers of the materials they use and owe use tax on untaxed out-of-state purchases.
- Residential and home improvement work needs a license above $2,000; commercial work at $50,000 or more. Residential roofers need a state registration.
- Workers' comp applies at three employees generally, two in building work, and one if you subcontract or are a sub.

## Why Arkansas is different for contractors

Arkansas is one of the few southern states that taxes certain **installation and repair labor** on items attached to buildings. Its rules list services such as "initial installation, alteration, addition, cleaning, refinishing, replacement, and repair" of appliances, flooring, motors and machinery, and they apply whether or not the item is affixed to real property. Whether the building is **new or existing** usually decides whether you collect tax. Arkansas also has one of the lowest residential license triggers we've seen: just over $2,000.

This is a summary of the Department of Finance and Administration (DFA) rules and licensing laws as of 2026-10-19, not tax advice. Arkansas's service rules are detailed, so check specific jobs with DFA and a CPA.

## Is contractor labor taxable in Arkansas?

Sometimes. In new or substantially modified buildings, installers "are acting as contractors and are not providing taxable services" (26 CAR § 30-519). But "initial installation in an existing building is taxable," and installers "should collect tax on the labor charged to install the mechanical or electrical components." "Any materials or parts installed are taxable to the customer." "The repair or replacement of flooring is taxable" too.

**Arkansas sales tax on common contractor jobs**

| Job | Taxable? |
| --- | --- |
| Installing HVAC equipment in a new house | No; installer acts as a contractor and pays tax on materials |
| Replacing a furnace motor in an existing home | Yes; tax on labor and parts |
| Replacing flooring in an existing building | Yes |
| Weekly lawn care or landscaping | Yes; listed taxable service |
| Framing or roofing on a new building | Contractor pays tax on materials; check roofing repair rules with DFA |

Billing matters. If you mix taxable and nontaxable charges, the nontaxable part must be stated separately or "the entire charge will be taxable."

## Who pays tax on materials in Arkansas?

"All contractors are deemed to be consumers or users of all tangible personal property" they use (26 CAR § 30-1003). Pay tax when you buy, and "use tax is required to be reported and paid on the purchase of materials from out-of-state sellers." If you perform both taxable and nontaxable services or sell at retail, you need a sales tax permit. See [use tax for contractors](https://www.brix.so/learn/use-tax-for-contractors) and [sales tax on labor vs. materials](https://www.brix.so/learn/sales-tax-on-labor-vs-materials).

## What is the Arkansas sales tax rate?

The state sales and use tax rate is **6.5%**, effective July 1, 2013. The state reduced food tax dropped to 0% on January 1, 2026, which doesn't affect construction materials. Cities and counties add their own taxes; DFA publishes the local rate table monthly.

## Which Arkansas contractor licenses do you need?

The Contractors Licensing Board (commercial) and its Residential Contractors Committee sit under the Department of Labor and Licensing. A commercial license is needed for work other than single-family homes when the cost, "including, but not limited to, labor and materials, is fifty thousand dollars ($50,000) or more." Residential builders and home improvement contractors are exempt only when the work "does not exceed two thousand dollars ($2,000)." Splitting a job to stay under either line isn't allowed.

Electrical, HVACR and plumbing licenses have no dollar minimum: HVACR law says "it is unlawful for any person to engage in HVACR work without the appropriate license or registration." A journeyman electrician can't contract with the public without employing a master electrician. **Local licensing:** cities issue privilege licenses and permits; check with the city. ## What income taxes apply in Arkansas?

DFA cut the top individual rate "from 4.4% to 3.9%." Its latest published bracket table is for **tax year 2025**, where income over $100,000 is taxed at "$3,809 + 3.9% of the excess over $100,000." DFA hadn't posted 2026 brackets when we checked, so confirm with the department. Corporations pay a graduated **1.0% to 4.3%**, with 4.3% on income over $11,000.

Individuals whose net tax is $1,000 or more and who don't make estimated payments (Form AR1000ES) or have 90% withheld face a 10% penalty. ## When do Arkansas contractors need workers' comp?

The Arkansas Workers' Compensation Commission's thresholds are layered. Coverage is required where "three (3) or more employees are employed by the same employer," where "two (2) or more employees are engaged in building or building repair work," and where one or more employees work for a contractor who subcontracts or for a subcontractor. Owners, sole proprietors and full-time partners count. Owners with no employees can apply for a Certificate of Non-Coverage. See [workers' compensation for contractors](https://www.brix.so/learn/workers-compensation).

## Local taxes in Arkansas

- **City and county sales and use taxes** on top of 6.5%, published monthly by DFA.
- **Local tax on taxable services**, like install labor in existing buildings, at the job location's rate. Ask DFA how to source it.
- **City privilege licenses and permits.**

BRIX quotes and invoices break out labor, parts and materials on separate lines, which Arkansas requires to keep nontaxable charges from being taxed. It also tracks licenses, roofing registrations and insurance and flags renewals. Your CPA still decides what's taxable.
