# Oklahoma Contractor Taxes and Licensing: Materials Tax, CIB Licenses and Income Tax

"Oklahoma does not collect sales tax on contracts or labor for improvements to real property," according to the Oklahoma Tax Commission. Contractors pay the 4.5% state sales tax plus local tax on the materials they buy for the job instead. Out-of-state contractors must register with the OTC and post a bond on contracts over $100,000.

## Key takeaways

- Labor and contracts for real property improvements aren't taxed; tax is paid on materials.
- State sales and use tax is 4.5%, with city and county taxes on top.
- No state general contractor license, but electrical, mechanical and plumbing contractors need CIB licenses with a $5,000 bond and $50,000 liability insurance.
- Roofers register with the CIB now, and a Residential Roofing Endorsement becomes mandatory on January 1, 2028.
- 2026 individual income tax tops out at 4.5%; corporate tax is 4%; the franchise tax ended after tax year 2023.

## What's distinctive about Oklahoma for contractors?

Oklahoma keeps contractor sales tax simple and pushes the complexity into **trade licensing**. The state has no general contractor license at all: the Construction Industries Board (CIB) says outright that "General Contractors are not currently required to have a state license in Oklahoma." But electrical, mechanical and plumbing contractors carry bond and insurance requirements, and residential roofing is getting a new mandatory endorsement. Out-of-state contractors face their own tax registration and bonding rules.

This page summarizes the Oklahoma Tax Commission (OTC), the CIB and state law as of 2026-10-19. It isn't tax advice. Ask a CPA who works with Oklahoma contractors before relying on it.

## Is contractor labor taxable in Oklahoma?

Not for improvements to real property. The OTC's Help Center answers: "No, Oklahoma does not collect sales tax on contracts or labor for improvements to real property." It adds, "Tax is paid on materials needed to complete the job; The job itself is not subject to sales tax." The Help Center doesn't separate repair from new construction or residential from commercial, so check repair-only work with the OTC.

## Who pays tax on materials, and what about out-of-state contractors?

The contractor does, as the consumer. Pay sales tax when you buy materials, or accrue use tax if a vendor doesn't charge it; see [use tax for contractors](https://www.brix.so/learn/use-tax-for-contractors). Oklahoma-based contractors don't post a tax bond.

- "We require all nonresident contractors working in Oklahoma to complete a nonresident contractor application," the OTC says.
- A bond is needed "if the contract is over $100,000.00 and you are a nonresident contractor." OTC Packet N calls for Form BT-163, Nonresident Contractor's Bond, "in the amount of three times the estimated tax liability to be incurred under your contract," along with a Form BT-175 notice of contract.
- Packet N, quoting state law, says an unregistered nonresident contractor can be fined up to 10% of its total bid.

For a comparison with states that tax labor, see [sales tax on labor vs. materials](https://www.brix.so/learn/sales-tax-on-labor-vs-materials).

## What's the sales tax rate in Oklahoma?

"Oklahoma's state sales and use tax rate is 4.5%," and city and county taxes may apply on top. Local rates vary widely, so look up the rate for the location where materials are delivered using the OTC's rate tools.

## Which Oklahoma contractor licenses do you need?

The CIB says "trade licenses/registrations are required for performing, or offering to perform, licensed/registered trade work." An active electrical, mechanical or plumbing contractor license requires "a five thousand dollar ($5,000.00) Corporate Surety Bond" and "a minimum of $50,000.00 commercial general liability insurance." We found no dollar threshold: the license applies to any trade job.

> Under HB 1628, as amended, a Residential Roofing Endorsement will be required for all residential roofing from January 1, 2028. The CIB says "the Grandfathering transition period starts on January 1, 2027 and ends on January 1, 2028."
>
> "Labor-only crews must be registered and work directly for a roofing contractor who holds a Residential Roofing Endorsement." The CIB lists a $230 application fee and $100 renewal.

**Local licensing:** with no state general contractor license, cities handle building permits and may register contractors. Check with the building department where you work. See our [contractor license guide](https://www.brix.so/learn/contractor-license).

## What income and business taxes apply in Oklahoma?

HB 2764, approved May 28, 2025, sets 2026 individual brackets. For single filers: 0% on the first $3,750, 2.5% on the next $1,150, 3.5% on the next $2,300 and **4.5%** on the rest. Joint filers get double-width brackets: 0% on the first $7,500, then 2.5%, 3.5% and 4.5%. Further cuts depend on revenue triggers.

Corporations pay **4%** of taxable income and must make estimated payments with "an estimated income tax liability of $500 or more." The OTC says "Oklahoma's franchise tax has been eliminated," and "tax year 2023 is the last year that franchise tax returns will be required to be filed." Plan state and federal [quarterly estimated taxes](https://www.brix.so/learn/quarterly-estimated-taxes-for-contractors), and run numbers in the [quarterly estimated tax calculator](https://www.brix.so/tools/quarterly-estimated-tax-calculator). Check Oklahoma's individual estimate rules with the OTC.

## When do Oklahoma contractors need workers' comp?

Title 85A says "every employer shall secure compensation as provided under this act to its employees," and the state notes coverage is available from its state-owned carrier, CompSource Mutual. Specific exclusions apply; check with the Workers' Compensation Commission. Owners and officers who aren't subcontractors may exclude themselves under § 8, though an Attorney General opinion cited on state forms reads that more narrowly, so confirm with the Commission. If a sub doesn't carry coverage, "the prime contractor shall be liable for compensation to the employees of the subcontractor." See [workers' compensation for contractors](https://www.brix.so/learn/workers-compensation).

## Local taxes in Oklahoma

- **City and county sales and use taxes** on top of the 4.5% state rate, on your materials.
- **City permits and contractor registration** where cities require them.
- **Nonresident registration and bonding** with the OTC for out-of-state firms.
