# Utah Contractor Taxes and Licensing Guide

Usually no. On a Utah furnish-and-install job, the contractor pays sales tax when buying the materials, and the charge to the property owner isn't taxable. Labor to repair real property is exempt, but labor to repair tangible personal property, like a built-in dishwasher, is taxed. Utah's individual income tax rate is 4.45% for 2026.

## Key takeaways

- Real property contractors pay sales tax on materials. The bill to the owner isn't taxed, and you can't show tax on it.
- Repair labor on tangible personal property is taxable. Installation labor is exempt only if it's listed separately.
- The Q4 2026 rate chart lists a 4.85% state share (4.70% plus a 0.15% Medicaid component), with combined rates from 6.35% to 10.05%.
- Utah taxes individual and corporate income at 4.45% for taxable years starting January 1, 2026; corporations pay at least $100.
- DOPL licenses general and specialty contractors; electrical and plumbing contractors need a master-licensed qualifier. Comp comes from an authorized insurer or self-insurance.

## Is labor taxable for Utah contractors?

It depends on what you're working on. Utah's Pub 42 draws the line between real property and tangible personal property. Lumber, nails, cement and fixtures like furnaces and water heaters become real property once they're installed. When you furnish and install, the Tax Commission says "the seller becomes a real property contractor," and "the contractor must pay sales tax on the purchase of the materials, while the transaction between the contractor and the real property owner is not taxable."

Repair work is where Utah gets specific. Pub 42 says "charges for labor to repair, clean, wash or renovate tangible personal property are subject to sales tax." Labor to service, repair or improve real property is exempt. Labor on personal property attached to real property is exempt only if it's separately stated, or "the entire charge for labor and parts is taxable." Appliances like a dishwasher, refrigerator, stove or washer don't count as permanently attached, so all repair charges on them are taxed, even if the unit is built in.

> **Example (illustrative numbers): two jobs in one week**
>
> Monday you finish a $15,000 basement under a furnish-and-install contract, with $6,000 in materials. You paid tax on the $6,000 at the supply house. At an illustrative 7.25% rate that's $435, which belongs in your bid. The homeowner's $15,000 invoice carries no tax.
>
> Friday you fix a built-in dishwasher: $180 labor and $70 in parts. Pub 42 treats both as taxable, so at the same illustrative 7.25% you'd collect about $18.13 in sales tax on the $250.

Pub 42 also bans three habits on furnish-and-install jobs. You may not collect sales tax on the transaction, offset the tax you owe on materials with tax you wrongly collected, or show tax "(or any amount that appears to be tax) as a separate item" on the invoice. If you collect it anyway, you must pay it to the Tax Commission unless you refund the buyer. Our [labor vs. materials guide](https://www.brix.so/learn/sales-tax-on-labor-vs-materials) compares how states handle this.

## How do materials, resale purchases and use tax work in Utah?

- **Owner-bought materials.** If the property owner buys materials for you to install, Pub 42 says the owner pays the sales tax, not you.
- **Buying for resale.** Materials you resell as personal property, like a storm door sold for do-it-yourself install, are bought tax-free for resale and you collect tax from the buyer.
- **Use tax.** Buy materials tax-free for resale and then install them or use them yourself, and you "must pay use tax on the purchase." Our [use tax guide](https://www.brix.so/learn/use-tax-for-contractors) explains how to report it.
- **Schools, churches and charities.** Construction materials bought for a public school or a religious or charitable organization can be exempt. You give the supplier form TC-721G or TC-721RC, and you must be able to show in an audit that the items were built into the exempt owner's property.
- **Out-of-state jobs.** Materials later built into real property outside Utah are exempt if the other state has no comparable tax or doesn't credit Utah tax.

## What does it take to get a Utah contractor license?

The Division of Professional Licensing (DOPL) licenses contractors by classification, and the scope for each one is in Utah Admin. Rule R156-55a. General licenses (B100, R100, E100) need two years or 4,000 hours of paid construction experience and a passing score on the Utah Business & Law exam. Specialty contractors take a 25-hour pre-licensure course. Every active license must carry general liability coverage of at least $1,000,000 per incident and $2,000,000 aggregate, with DOPL listed as certificate holder. DOPL's application notes that a bond may be required before a license is issued. See our [contractor license guide](https://www.brix.so/learn/contractor-license) for how classifications work in general.

**Utah contractor classifications by trade (DOPL, checked 2026-10-19)**

| Trade | Agency | Credential | Link |

_Bond criteria are in Utah Code 58-55-306 and Admin. Rule R156-55a-602. Confirm current requirements with DOPL before you apply._

Utah's small-job exemption is larger than many states'. Utah Code 58-55-305 exempts building repair, remodeling or improvement with a contracted value under $7,000, labor and materials included. Plumbing, electrical, HVAC, gas appliance, fire sprinkler and alarm work still need the right licensed person. Above $3,000, you must file a one-time affirmation with DOPL that you carry liability insurance and, if you have employees, workers' comp. The statute notes the section is renumbered January 1, 2027, so recheck the citation after that date.

One more change to know about: DOPL announced on June 11, 2026 that the Residence Lien Recovery Fund "is now depleted." Homeowners who paid a licensed contractor in full under a written contract can still get a Certificate of Compliance that forces lien removal, but unpaid subs and suppliers "must rely on standard legal avenues." That makes your own [mechanics lien](https://www.brix.so/learn/mechanics-lien) rights more important.

## What income and franchise tax does a Utah contractor pay?

Utah uses one flat rate. Utah Code 59-10-104, effective January 1, 2026, sets individual income tax at 4.45% of state taxable income. The Tax Commission's rate page lists 4.5% for 2025. Corporations pay franchise or income tax at the same 4.45% under Utah Code 59-7-104, with a $100 minimum. If you're a sole proprietor or LLC owner, your business profit flows to your personal return, so set money aside with the [quarterly estimated tax calculator](https://www.brix.so/tools/quarterly-estimated-tax-calculator). Federal income and self-employment tax still apply on top.

## Do Utah contractors have to carry workers' comp?

If you have employees, yes. The Labor Commission's Industrial Accidents Division says "with few exceptions, all employers must provide workers' compensation coverage for their employees." Utah Code 34A-2-201 lets you meet that by insuring with an insurer authorized to write workers' comp in Utah, or by getting approval to self-insure. DOPL asks for a comp certificate naming DOPL as holder when you apply, or a Workers Compensation Coverage Waiver from the Labor Commission if you have no employees. DOPL's FAQ also warns that paying workers as 1099s doesn't get around it. Our [workers' compensation guide](https://www.brix.so/learn/workers-compensation) covers how premiums are set.

## How do local sales tax rates work in Utah?

- **Combined rates.** The Tax Commission says "the entire combined rate is due on all taxable transactions" in a jurisdiction. In the Q4 2026 chart, Salt Lake City is 8.45%, Provo 7.45%, St. George 6.75% and Park City 9.55%.
- **Quarterly updates.** The Commission posts a new combined rate chart each quarter. Check the current one before you price taxable repair work.
- **Neighbors.** Crossing the border for work? See [Nevada](https://www.brix.so/taxes/nevada), [Idaho](https://www.brix.so/taxes/idaho) or [Colorado](https://www.brix.so/taxes/colorado).

## Frequently asked questions

### Do I charge sales tax on a furnish-and-install job in Utah?

No. Pub 42 says the real property contractor pays sales tax on the materials and the sale to the property owner isn't taxable. You may not collect tax on the job or show your materials tax as a line item. Tax collected by mistake must go to the Tax Commission unless you refund it.

### Is repair labor taxable in Utah?

It depends on what you repair. Labor to repair real property is exempt, and labor on personal property permanently attached to real property is exempt if listed separately. Labor to repair tangible personal property, including built-in dishwashers, refrigerators and stoves, is taxable along with the parts.

### What is Utah's sales tax rate for contractors?

The Q4 2026 combined rate chart shows a 4.70% state rate plus a 0.15% state Medicaid component, and combined rates from 6.35% to 10.05% depending on location. Real property contractors usually pay this tax to suppliers on materials rather than collecting it from owners.

### What is the Utah income tax rate for 2026?

Utah Code 59-10-104 sets the individual rate at 4.45% effective January 1, 2026. The corporate franchise and income tax rate is also 4.45%, with a $100 minimum. The Tax Commission's rate page lists 4.5% for 2025.

### How much work can I do in Utah without a contractor license?

Utah Code 58-55-305 exempts building repair or remodeling jobs under $7,000, labor and materials included. Plumbing, electrical, HVAC and several other trades still need licensed workers on those jobs. Above $3,000 you must file an insurance affirmation with DOPL.

### What insurance does DOPL require for a contractor license?

General liability of at least $1,000,000 per incident and $2,000,000 aggregate, with DOPL as certificate holder. If you have employees, you also need workers' comp, and if you don't, a coverage waiver from the Labor Commission. DOPL says a bond may also be required.

### Can the Residence Lien Recovery Fund pay me as an unpaid sub?

Not in practice. DOPL announced in June 2026 that the fund is depleted. Homeowners can still get a Certificate of Compliance if they paid a licensed contractor in full under a written contract, but unpaid subs and suppliers have to use normal collection and lien remedies.
