West Virginia Contractor Taxes and Licensing: Repair vs. Capital Improvement
By BRIX Editorial Team · Updated
In West Virginia, the result of the job decides the tax. If your work creates a capital improvement, it's nontaxable contracting and you pay tax on your materials. If it's a repair, maintenance or installation that isn't a capital improvement, you charge 6% state sales tax on labor and materials, plus 1% where a municipality adds its own tax.
Key takeaways
- Repair, maintenance and non-capital installation work is a taxable service in West Virginia: tax applies to labor and materials.
- Capital improvements are exempt contracting, but you pay sales or use tax on everything you buy for them.
- The state rate is 6%. Municipalities that impose their own tax add 1%, for 7% combined.
- A state contractor license is required when a job costs $5,000 or more for residential work or $25,000 or more for commercial work.
- Employers that regularly employ even one person must carry workers' comp, bought from private carriers.
Why do West Virginia contractors have to sort every job?
West Virginia taxes contractors two ways, depending on what the job leaves behind. The Tax Division's Publication TSD-310 (revised July 2026) says people in the construction trades must classify work on real property as either a capital improvement or a non-capital improvement repair, maintenance or installation service. The first is nontaxable "contracting." The second is a taxable service, and you collect tax on both labor and materials.
That means a roofer, plumber or HVAC shop can run taxable and nontaxable jobs in the same week. Get the call wrong and TSD-310 says you're personally liable for tax you failed to collect. Compare Virginia, where repair labor on real estate generally isn't taxed, and Pennsylvania and Maryland if you work across those lines.
Is contractor labor taxable in West Virginia?
It depends on the result. TSD-310 defines a capital improvement as an addition or alteration to real property that meets all three tests:
- It substantially adds to the value of the real property or appreciably prolongs its useful life.
- It becomes part of the real property or is permanently affixed, so removal would cause material damage.
- It's intended to be a permanent installation or to remain for an indefinite period.
If the job passes, the labor is nontaxable. If it's a repair, alteration, maintenance or installation that doesn't pass, it's taxable. TSD-310's own roofing examples show the line: a complete roof replacement (the entire building, a complete side, or the complete roof on a wing or dormer) is a capital improvement, while repairing or replacing shingles, flashing or partial gutter runs is taxable repair work. The publication's classification chart covers dozens of other items, from water heaters to septic systems.
The rate. The state rate is 6%. The Tax Division says each municipality that imposes its own sales and use tax adds 1%, for a combined 7%, and it publishes the list of municipalities and effective dates. TSD-310 says the municipal tax applies when the work is performed inside a municipality that imposes it. For the big-picture models, see sales tax on labor vs. materials.
How are materials and use tax handled in West Virginia?
It flips with the job type:
- Capital improvement jobs: you don't collect tax from the customer, but TSD-310 says you must generally pay sales or use tax on all machinery, equipment, tools and materials you buy for the work.
- Taxable repair and maintenance jobs: you collect tax on the full charge. You may buy parts, materials and appliances tax-free only if they're resold and physically transferred to the customer, by giving your supplier a completed exemption certificate claiming the purchase for resale.
- Pass-through exemptions: a contractor generally can't use its customer's exemption. TSD-310 lists exceptions, such as qualifying work for manufacturing, utilities, natural resource production and certain high-tech businesses. Check the publication before you skip tax.
- Public schools: effective July 1, 2026 under HB 4028, services and building materials installed in a public school facility are exempt. TSD-310 says you can present Exemption Certificate F0003 at purchase or claim a refund on Form CST-240.
If you collect tax and don't yet have a Combined Sales and Use Tax account, the Tax Division says to contact it so one can be opened; returns are filed on Form WV/CST-200CU or online at MyTaxes. Because TSD-310 says capital improvement contractors owe sales or use tax on their materials, anything bought out of state without West Virginia tax still owes use tax when you use it here. More: use tax for contractors.
What contractor licenses does West Virginia require?
West Virginia licenses contractors statewide through the Contractor Licensing Board, with the Division of Labor's Licensing Section handling administration and enforcement. Under W. Va. Code § 30-42-3, you're a "contractor" when the cost of the undertaking is $5,000 or more for residential work or $25,000 or more for commercial work. The code sets classifications including general building, general engineering, residential, multifamily, electrical, plumbing, piping, HVAC and specialty.
| Trade | Agency | License or registration | Link |
|---|---|---|---|
| General contractor / home improvement | WV Contractor Licensing Board (Division of Labor) | Contractor license in the residential, general building or multifamily classification at the $5,000 residential / $25,000 commercial line | Contractor Licensing Board |
| Electrical | WV State Fire Marshal; Contractor Licensing Board | Individual journeyman, master or specialty electrician license from the Fire Marshal, plus an electrical contractor classification for the business | W. Va. Code § 29-3B-2 |
| Plumbing | WV Division of Labor; Contractor Licensing Board | Individual master, journeyman or plumber-in-training license, plus a plumbing contractor classification | Plumber licensing |
| HVAC | WV Division of Labor; Contractor Licensing Board | Individual HVAC technician, residential technician or technician-in-training certification, plus an HVAC contractor classification | HVAC certification |
| Roofing | WV Contractor Licensing Board | No separate state roofing license; a contractor license applies at the dollar threshold. Check the board for the right classification | Contractor Licensing Board |
| Crane operation | WV Division of Labor | Crane operator certification; check with the division | Division of Labor licensing |
Building permits, and any local business license, come from the city or county, so call the local office before starting work. Factory-built home dealers follow separate tax rules in Publication TSD-315. For the general picture, see contractor license.
How much is West Virginia income tax for contractors in 2026?
West Virginia has cut its personal income tax rates several years running. For taxable years beginning on or after January 1, 2026, W. Va. Code § 11-21-4j sets these rates for single, joint and head-of-household filers (married filing separately uses half-size brackets):
| Taxable income | Tax |
|---|---|
| Up to $10,000 | 2.11% |
| $10,000 to $25,000 | $211 + 2.81% of the excess over $10,000 |
| $25,000 to $40,000 | $632.50 + 3.16% of the excess over $25,000 |
| $40,000 to $60,000 | $1,106.50 + 4.22% of the excess over $40,000 |
| Over $60,000 | $1,950.50 + 4.58% of the excess over $60,000 |
Sole props, partners, LLC members and S corp shareholders report their share of profit here. West Virginia also lets a pass-through entity that isn't a disregarded entity elect to pay tax at the entity level at a rate equal to the top individual rate, for taxable years beginning on or after January 1, 2022 (§ 11-21-3a). The election is made yearly on a Tax Commissioner form. C corporations pay corporation net income tax, which § 11-24-4 sets at 6.5%.
Estimated tax. Under § 11-21-55, you must file a declaration if your West Virginia income not subject to withholding can reasonably be expected to exceed $400 plus your personal exemptions. If you're required by April 15, § 11-21-56 sets four equal installments: at filing, then June 15, September 15 and January 15. Who needs workers' comp in West Virginia?
Almost every employer. W. Va. Code § 23-2-1 covers anyone regularly employing another person or persons. The main construction-relevant carve-out is the casual employer: three or fewer employees whose work is temporary, intermittent and sporadic and doesn't exceed 10 calendar days in a quarter. Few crews fit that.
Owners can opt themselves out. Sole proprietors and partners may be excluded; corporations can exclude board members and the president, vice president, secretary and treasurer; and an LLC can exclude up to four managers, officers or members. Coverage comes from private carriers: the Offices of the Insurance Commissioner says the market opened in 2006 and now has more than 350 carriers, and it requires employers to post a notice with carrier information. More: workers' compensation.
Frequently asked questions
Do West Virginia contractors charge sales tax on labor?
Sometimes. If the job is a repair, maintenance or installation that isn't a capital improvement, TSD-310 says you collect sales tax on both labor and materials. If the job results in a capital improvement, the labor isn't taxed, but you pay tax on the materials you buy.
What counts as a capital improvement in West Virginia?
TSD-310 requires all three: the work substantially adds value or prolongs the property's life, it becomes part of or is permanently affixed to the real property, and it's intended to be permanent. A complete roof replacement qualifies; replacing some shingles is taxable repair.
What is the sales tax rate for contractors in West Virginia?
The state rate is 6%. Municipalities that impose their own sales and use tax add 1%, making 7% combined. Check the Tax Division's list of municipalities and effective dates for each job site.
When do I need a West Virginia contractor license?
W. Va. Code § 30-42-3 defines a contractor by job cost: $5,000 or more for residential work, or $25,000 or more for commercial work. Above those lines you need a Contractor Licensing Board license in the right classification. Electricians, plumbers and HVAC technicians also need individual licenses.
Who licenses electricians in West Virginia?
The State Fire Marshal. W. Va. Code § 29-3B-2 says no electrical work may be done for pay without a license and certificate from the Fire Marshal, with journeyman, master and specialty classes. The business also needs an electrical classification from the Contractor Licensing Board.
Can a West Virginia LLC pay income tax at the entity level?
Yes. Under § 11-21-3a, a pass-through entity that isn't a disregarded entity can elect each year to pay tax at a rate equal to the top individual rate, which is 4.58% for 2026 under § 11-21-4j. Ask a CPA whether the election helps your federal return.
Do I need workers' comp in West Virginia with one employee?
Generally yes. The statute covers employers regularly employing one or more people, with a narrow exception for casual employers. Sole proprietors, partners and some officers and LLC members can exclude themselves, but your employees must be covered.
